Our great American heritage includes a birth right to liberty. We are endowed by our Creator--the Declaration of Independence tells us--with certain inalienable rights, including life, liberty, and the pursuit of happiness. Indeed, the essential definition of an unjust government is one that forfeits our right to liberty or to life for the political ends of those in power.

I write on behalf of the Coalition to End FDA and FTC Censorship, to seek your help in ending federal government practices that are destroying the fabric of America by taking life and liberty through censorship of health information. That censorship is politically driven by the most powerful companies in the world, the pharmaceutical industry, and is implemented by an agency of the government controlled by the pharmaceutical industry, the Food and Drug Administration.

We are asking you to take a few simple steps to protect you and your family from this loss of liberty that also sacrifices health. Our freedom of speech is a very precious right, I think you would agree. The right to receive life saving and life enhancing information is another very precious right, I think you would also agree.

It may shock you, as it did me upon first learning, that the FDA prohibits every claim that a nutrient treats a disease. It is against the law in this great country for anyone at the point of sale to inform a consumer of the truthful treatment effects of foods and dietary ingredients. If a seller of prune juice puts on the label of that product the fact that it treats chronic constipation, that seller can go to jail. It is likewise illegal for the sellers of fish oil and fish to tell you that the omega-3 fatty acids in fish can reduce the risk of sudden death heart attacks by as many as 110,000 per year; that glucosamine and chondroitin sulfate can treat osteoarthritis in the twenty million Americans afflicted with that condition; or that saw palmetto can treat an enlarged prostate, a condition afflicting 50% of all men aged 50 and older.

To protect drug companies from competition, the FDA is in the business of condemning and removing from the market with the full force of law all sources of competition that arise to FDA approved drugs. This is corruption that costs lives. It helps no one but the large drug companies. For them, it means billions in profits; for us it means the loss of truth, of health, and of life itself.

The FDA is not alone. The FTC also violates constitutional rights. The FTC presumes those it accuses of deceptive advertising guilty until proven innocent, a violation of the Fifth Amendment to the Constitution. In its deceptive advertising cases, the FTC compels those it accuses, even before formal charges are brought, to give FTC all the confidential financial, business, and trade secret information they possess. Rather than the FTC having to prove the ads it challenges to be false, it deems them false unless the accused proves the ads true. It is not enough that the ad content is true, the FTC makes the advertiser prove every conceivable implied meaning of the ad true and to a conclusive degree, something all but impossible in science. Even if all ad content is proven true, FTC can still condemn the advertiser on the theory that the most gullible consumer would be misled by the truth! This system offends the very basic notions of due process that underlie the Fifth Amendment. It is f reezing out of the market all manner of truthful health information.
